1. Terms & Conditions of Sale
   The following Terms & Conditions apply to the live public auction conducted by Michael Hoffman, Auctioneer, and Hoffman Auctions. By registering for a bidder number, accepting a bidder card, or bidding at this auction, each bidder agrees to be bound by these Terms & Conditions. Any announcements made by the auctioneer on auction day take precedence over printed or advertised material and become part of these Terms & Conditions.

2. Live Auction Format
   This is a live, on-site public auction. Items will be offered in the order determined by the auctioneer. The auctioneer reserves the right to group, split, combine, add, remove, or withdraw items from the auction at any time prior to the completion of the sale.

3. Buyer’s Premium
   A 10% buyer’s premium will be added to all purchases. For example, if you bid $100.00, your total purchase price before any applicable tax or fees will be $110.00.

4. Payment Terms
   Cash only on vehicles and trailer. Visa and Mastercard accepted on all other purchases. We do not accept checks of any kind. Payment is due in full on auction day before items are removed from the auction site.

5. Titled Vehicles and Trailer
   Cash is required for all titled vehicles and trailer. Titles will not transfer until payment has been made in full and funds have been verified. Vehicles and trailer are sold strictly as-is, where-is, with no guarantees or warranties of any kind. Mileage, condition, mechanical statements, and related information are provided as a courtesy only and are not guaranteed.

6. As-Is, Where-Is
   All items are sold as-is, where-is, with all faults, defects, and imperfections, whether known or unknown. There are no guarantees, warranties, refunds, returns, or exchanges. Buyers are responsible for inspecting items before bidding and determining condition, completeness, authenticity, value, and suitability for their intended use.

7. Buyer’s Responsibility
   By bidding, the buyer acknowledges that they have inspected the item to their satisfaction or have chosen not to inspect it. It is the bidder’s responsibility to determine age, condition, authenticity, value, completeness, and any other factor relevant to their bidding decision. When in doubt, bid accordingly.

8. Catalog, Photos, and Descriptions
   Descriptions, photographs, captions, advertisements, and oral statements are provided as a guide only and represent opinions, not guarantees. While reasonable efforts are made to describe items accurately, Michael Hoffman, Auctioneer, Hoffman Auctions, and the seller are not responsible for errors, omissions, incorrect descriptions, or incorrect photographs. Announcements made auction day take precedence over prior advertising.

9. Auctioneer’s Authority
   The auctioneer has sole and final discretion in the conduct of the auction. The auctioneer may reject any bid, refuse to register any bidder, settle bidding disputes, reopen bidding, determine the successful bidder, or resell an item in the event of a dispute. The auctioneer’s decision is final.

10. Transfer of Risk
    The successful bidder assumes responsibility for each item at the fall of the hammer. Buyers are responsible for the security, loading, removal, and care of their purchases after the item is sold.

11. Removal and Load Out
    Items must be paid for in full before removal. Buyers are responsible for bringing their own boxes, packing materials, tools, help, and equipment needed for removal. Auction staff does not guarantee loading assistance. Any item left after the designated removal time may be considered abandoned unless prior arrangements have been made with Michael Hoffman, Auctioneer.

12. Abandoned Items
    Any item not removed during the stated removal period, unless alternate arrangements have been approved by Michael Hoffman, Auctioneer, may be considered abandoned. Abandoned items may be disposed of, resold, donated, or otherwise handled at the auctioneer’s discretion. No refunds will be given for abandoned items, and disposal fees may be assessed if applicable.

13. No Shipping
    This is a live, on-site auction. No shipping is offered for this auction. Buyers are responsible for removing their purchases from the auction location.

14. Absentee Bidding
    Absentee bids may be accepted at the sole discretion of Michael Hoffman, Auctioneer as a courtesy to bidders who cannot attend. Absentee bids will be executed as if the bidder were present and bidding on their own behalf. Michael Hoffman, Auctioneer assumes no responsibility for failure to execute absentee bids for any reason.

15. Reserves and Minimum Bids
    Some items may be offered subject to seller confirmation, reserve, or minimum bid. The auctioneer may disclose or withhold the amount of any reserve at the auctioneer’s discretion.

16. Failure to Pay
    If a buyer fails to pay for purchases in full, Michael Hoffman, Auctioneer may cancel the sale, resell the item, block the buyer from future auctions, and pursue any remedies allowed by law. A defaulting buyer may be held responsible for any loss, deficiency, collection costs, attorney fees, expenses of resale, and any other damages resulting from non-payment.

17. Failure to Deliver Property
    If Michael Hoffman, Auctioneer is prevented from delivering any property due to theft, damage, loss, fire, casualty, or any other reason beyond the auctioneer’s control, the auctioneer’s liability shall be limited to the amount actually paid by the purchaser for that item. No incidental or consequential damages shall be allowed.

18. Connected or Grouped Items
    Do not assume that items shown together, connected together, or located near each other are being sold together. Listen to the auctioneer and bid only on the item or group of items being offered at that time.

19. Choose Wisely
    All sales are final. Bidders are responsible for their own bidding decisions. If a buyer bids on the wrong item, changes their mind, or later determines that an item is not suited for their intended use, no refund or adjustment will be given.

20. Food Vendor and Facilities
    Food vendor and facilities are expected to be available on-site for this auction.

21. Disputes
    Any disputes arising from this auction or any resulting transaction shall be handled directly with Michael Hoffman, Auctioneer. Any legal proceeding shall be filed and conducted in the appropriate court in the State of Ohio. The purchaser agrees that participation in the auction constitutes acceptance of these Terms & Conditions.

22. Limitation of Liability
    Except as expressly stated above, all property is sold as-is, where-is. Neither Michael Hoffman, Auctioneer, Hoffman Auctions, nor the seller makes any representation or warranty, express or implied, as to condition, merchantability, fitness, authenticity, title, value, description, or suitability of any item. The purchaser acknowledges and agrees that Michael Hoffman, Auctioneer and Hoffman Auctions shall not be liable for incidental, consequential, or compensatory damages beyond the amount actually paid for the item in question.

23. Additional Terms
    Michael Hoffman, Auctioneer reserves the right to add, remove, split, combine, or withdraw items; alter the order of sale; add minimum bids or reserves; correct errors; and make changes to auction procedures as needed. By registering for this auction, bidders agree to these Terms & Conditions.
